California Employment Laws That Protect You

California employees have some of the strongest workplace protections in the country. The California Fair Employment and Housing Act (FEHA), Gov. Code § 12940 prohibits employers with five or more employees from discriminating based on race, sex, religion, disability, age, pregnancy, national origin, and several other protected categories. It also bars harassment and retaliation against employees who report violations.

For employees who speak up about illegal activity, California Labor Code § 1102.5 provides broad whistleblower protections. An employer cannot demote, suspend, or terminate an employee for reporting a violation of state or federal law to a government agency or internally to management. Retaliation under this statute can expose an employer to substantial damages, including punitive damages when the conduct is especially egregious.

California also requires employers with five or more employees to comply with the California Family Rights Act (CFRA), which guarantees eligible employees up to 12 weeks of protected leave for qualifying family and medical reasons. Terminating an employee for taking or requesting CFRA leave is unlawful.
